Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Noir Cases, including the mobile application, website, API, digital case packs, and AI investigation partner (collectively, the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service

Noir Cases is an interactive mystery game. The Service includes fictional stories, evidence, case progress, and an AI investigation partner that helps you explore each case. We may add, change, or remove features and content as the Service develops. Some features may require an account or a purchase.

Accounts

You may need to sign in to use the Service and save your progress. You are responsible for keeping your account credentials secure and for activity carried out through your account. The information you provide must be accurate and kept up to date. Contact us promptly if you believe that someone has used your account without permission.

You may not create an account or use the Service if doing so is prohibited by the laws that apply to you. Noir Cases is not directed to children under 13. If you are under the age required to agree to these Terms in your location, use the Service only with the involvement and permission of a parent or legal guardian.

Purchases and App Stores

The Service may offer paid digital case packs or other in-app content. Prices, currencies, and what is included are shown before you complete a purchase. Paid case packs are digital content delivered through the Service and are not physical products.

Purchases are processed by Apple App Store or Google Play, not directly by Noir Cases. Your purchase is also subject to the applicable store’s terms, payment rules, and refund policies. Contact Apple or Google for refund requests, payment problems, or store-account issues, unless applicable law gives you a different right. We verify purchases with the relevant store before granting access to digital content.

Access to purchased content may depend on signing in to the Noir Cases account associated with the purchase. You must not transfer, resell, or share purchased access except where the applicable store or law expressly permits it.

AI Investigation Partner

The AI investigation partner generates responses from the information available to it. Its responses may be incomplete, inaccurate, or misleading and are provided for entertainment and gameplay only. Do not treat them as professional, legal, medical, financial, safety, or emergency advice. Do not use the Service to report an emergency or to make decisions that require reliable expert information.

Please do not submit passwords, payment card details, government identification numbers, health information, or other sensitive personal information in game chat. Our handling of information is described in the Privacy Policy.

Acceptable Use

You may use the Service only for personal, lawful, non-commercial entertainment. You must not:

• Break the law, infringe another person’s rights, or misuse another person’s identity or account.
• Probe, scan, attack, overload, disrupt, or interfere with the Service or its infrastructure.
• Reverse engineer, decompile, modify, or attempt to extract source code from the Service, except where applicable law permits it.
• Scrape, copy, redistribute, publicly perform, or commercially exploit the Service or its content without written permission.
• Circumvent purchase verification, access controls, or other security features.
• Upload or send content that is unlawful, threatening, abusive, discriminatory, deceptive, or intended to harm others.
• Use automation or the Service to develop or train a competing product without our written permission.

We may investigate suspected violations and take action, including limiting or suspending access.

Intellectual Property

Noir Cases and its software, stories, artwork, designs, names, trademarks, and other content are owned by or licensed to us and are protected by applicable intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own entertainment while you comply with these Terms. No other rights are granted.

If you send feedback, suggestions, or ideas about the Service, you allow us to use them without restriction or payment. This does not transfer ownership of your unrelated intellectual property.

Your Messages

You keep any rights you have in messages and other content you submit to the Service. You grant us the limited license needed to receive, store, process, display, and transmit that content to operate, secure, and support the Service, including sending relevant content to service providers that help us provide the AI investigation partner. Do not submit content you do not have the right to share.

Availability and Changes

We work to keep the Service available, but we do not guarantee uninterrupted or error-free access. The Service may be unavailable because of maintenance, updates, network conditions, device limitations, or events outside our reasonable control.

We may update these Terms when the Service or applicable requirements change. When we do, we will update the date above. If a change materially affects your rights, we will provide notice through the Service or another reasonable channel where required. Your continued use after the updated Terms take effect means you accept them.

Suspension and Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, create risk for other users or the Service, or if we are required to do so by law. Termination does not remove rights or obligations that are intended to continue, including provisions about purchases, intellectual property, disclaimers, limitations of liability, and disputes.

Deleting your account does not necessarily cancel a transaction or create a refund. For account-data deletion, see Delete My Data.

Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory. We do not guarantee that the Service will meet your requirements, remain available, preserve every item of progress, or be accurate, secure, or free of defects. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

Limitation of Liability

To the maximum extent permitted by law, Noir Cases and the people and providers involved in operating it will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, or goodwill, arising from or related to the Service or these Terms. Nothing in these Terms limits liability that cannot legally be limited or excludes your rights under mandatory consumer-protection laws.

Third-Party Services

The Service relies on third-party services, including Apple App Store, Google Play, sign-in providers, hosting providers, analytics providers, and AI service providers. Those services are governed by their own terms and policies. We are not responsible for third-party services that we do not control, except where applicable law provides otherwise.
